Hi,

If your child’s application for Adult Disability Payment (ADP) was turned down completely, or awarded at a lower rate than expected, you can still challenge the determination made by Social Security Scotland (SSS).

You might your needs haven’t been fully recognised, such as the level of care or supervision they require, or that professional evidence you provided with the ADP application hasn’t been properly considered by SSS.

If some ADP was awarded but you think you should have received more, seek advice from one of our Disability Benefit Specialists before challenging that determination. This is because SSS can look at the whole determination again and could decrease the award, as well as increase it or keep it the same.

You can challenge this determination, and the determination letter should include details of how you can do this. You can ask the SSS to look at the determination again – this is called a re-determination.

You have 42 days from the date on the determination letter to request a re-determination (if you have a good reason, you can request a re-determination up to 12 months after the determination). SSS must deal with your redetermination within 56 days.

How to apply for re-determination

You can request a re-determination by phone for free on 0800 182 2222 (Monday to Friday, 8am to 6pm), Text Relay Service on18001 +0300 244 4000 for the hard of hearing, or if you're a BSL user you can use the Contact Scotland service to contact SSS by video relay.

You can request a redetermination online using your "mygovscott" my account. You will need to register for an account if you don’t already have one.

 You can also request
in writing by filling in a re-determination request paper form (that should have been sent with your determination letter) and sending your completed form to SSS at the address below:

Social Security Scotland
PO Box 10303
Dundee
DD1 9FY

If you make the request by phone, we suggest you tell them further information will be sent in writing rather than giving it over the phone.

Supporting information

When you have requested a mandatory re-determination you can provide further information, including the reasons you disagree with their determination and additional supporting evidence. This information will be looked at along with the original information by a different case manager at SSS.

You can see more about supporting information  and what you can include. If you didn’t use these for the original claim, you may find there are extra things you can add in now.

Please see our information about filling in the ADP form. We also have information about challenging an ADP determination.

If you are unhappy with the outcome of the re-determination you can appeal. Please contact us for further information about this if you need to.
